The parents of the 13-year-old Pennsylvania boy accused of shooting his 5 year old brother now face charges of endangering a minor after “leaving [the] gun out.”

Sara Gerwig, 37, and Thomas Wolfe, of Penn Hills, Pennsylvania, face up to four counts of endangering minors each following the death of their 5 year old son Connor Wolfe on November 22.

His 13-year-old son, Keegan McGivern, admitted to investigators on December 14 that he shot his brother Connor with his father’s gun that he “always misses,” the criminal complaint says. It was originally thought that the 6 year old brother, Zach, shot Connor.

“Thomas admitted that he left his pistol on top of his gun safe in the first floor master bedroom,” the criminal complaint read. ‘

Thomas said the pistol is always loaded with a live bullet in the chamber. Thomas uses the gun as his everyday weapon when he leaves the house.

McGivern has been charged with murder after admitting to investigators that he grabbed the gun after getting angry with his three brothers: Zach, 6; Connor, 5, and Madolynn Wolfe, 3, because they were jumping on the bed, CBS reported.

“What happened in Penn Hills was an intentional act that resulted in the tragic death of a 5 year old boy,” the bureau said earlier this month. “The 13-year-old was charged as an adult because Pennsylvania law does not allow a criminal manslaughter charge to be filed directly in juvenile court.”

Allegheny Police said in their statement.

Keegan is being charged as an adult, the Allegheny County District Attorney’s Office said, because a murder charge cannot be filed in juvenile court in Pennsylvania.

“What happened in Penn Hills was an intentional act that resulted in the tragic death of a 5-year-old boy,” the prosecutor’s office said in a statement.

Police have also said that the children’s parents are partly guilty and that they may also face charges.

“Detectives determined that four children (ages 13, 6, 5 and 3) were left unsupervised while a loaded and unsecured pistol was left within reach of each child,” Allegheny Police said in their statement. “Detectives are also consulting with prosecutors to determine the level of guilt of the parents, so criminal charges are anticipated.”
